The Protection of Personal Information Act requires all organisations (private and public) to adhere to the regulation’s key principles when processing personal that is about a natural person or a juristic person.
The Act is also aimed at providing rights to people when it comes to unsolicited electronic communications. In reality, this impacts all organisations. POPIA presents a ‘real risk’ to all organisations due to the nature and size of the financial penalties and also the reputational damage associated with non-compliance.
The POPI Act applies to
Any organisation that has employees, customers, visitors, vendors and suppliers.
Any organisation that processes personal information on behalf of another organisation (for example a payroll service provider).
The maximum penalties for non-compliance are a R10-million fine, or imprisonment for a period of up to 10 years, or a combination of both.

Section 4 (e) of the POPIA regulations requires that an information officer must, in addition to the responsibilities referred to in section 55(1) of the Act, ensure that internal awareness sessions are conducted regarding the provisions of the Act.
